El tribunal retira el pasaporte a Diego Torres y le prohíbe salir de España
Iñaki Urdangarin no pisará de momento la cárcel. La Audiencia de Palma ha acordado este jueves mantener en libertad provisional al exduque y le ha impuesto solo la obligación de comparecer el día 1 de cada mes ante el consulado de Ginebra (Suiza) ciudad donde reside. Además, deberá comunicar al tribunal cualquier desplazamiento fuera de la UE o cualquier cambio de residencia, incluso temporal.
Las magistradas han argumentado que el «arraigo suficiente (familiar, social y laboral) en territorio nacional» y la «conducta» hasta ahora observada por los acusados permite estimar que «el incremento del riesgo de fuga» que puede suponer la sentencia que les condena puede ser «conjurado» con medidas cautelares «menos gravosas» que garanticen su sujeción al control del tribunal. Consideran las juezas que las acusaciones no han acreditado «circunstancia o marcador de riesgo» distinto al de la condena impuesta que, además, recuerdan, es el resultado de la suma del total de las penas.
El tribunal también mantiene en libertad provisional a Diego Torres, socio de Urdangarin en el Instituto Nóos, pero le prohíbe salir de España, le retira el pasaporte y le obliga a comparecer en el juzgado más próximo a su domicilio el día 1 de cada mes. Con esta decisión, las magistradas desestiman las medidas cautelares solicitadas por la Fiscalía Anticorrupción, que reclamaba prisión eludible con fianza, en un auto contra el que cabe recurso de súplica en el plazo de tres días.
El fiscal Pedro Horrach había solicitado para el marido de la infanta Cristina una fianza de 200.000 euros para evitar la prisión preventiva, dando marcha atrás en su intención inicial de no reclamar una fianza. Para Torres, la Fiscalía reclamaba incluso con una fianza menor que la del marido de la infanta Cristina, 100.000 euros, a pesar de haber sido condenado a una pena superior (ocho años y seis meses). Según fuentes de la Fiscalía, la diferencia en la cuantía solicitada responde a la distinta capacidad económica de cada uno de ellos.
LOS CONDENADOS NO HAN HABLADO
En la vista de medidas cautelares celebrada ante las magistradas que juzgaron el caso, las defensas de Urdangarin y Torres, ejercidas por Mario Pascual Vives y Manuel González Peeters, respectivamente, se han opuesto a las peticiones del fiscal. Los dos condenados solo han utilizado su turno para hacer suyas las palabras de sus letrados, según ha informado el Tribunal Superior de Justicia de Baleares.
La Abogacía del Estado ha solicitado un embargo y retención de ingresos para Torres, mientras que la Abogacía de Baleares se ha adherido a las peticiones formuladas por la Fiscalía para ambos condenados, en una vista que ha durado poco más de media hora. (Fuente: El Periódico)
