Los hechos son constitutivos de un delito contra la libertad sexual o de atentado a la autoridad.

La Fiscalía de Sevilla ha denunciado al empresario y exvocal de la Cámara de Comercio Manuel Muñoz Medina por los hechos ocurridos el día 20 de diciembre de 2016 en la sede de la Cámara, cuando el empresario se «abalanzó» sobre la coordinadora general de Podemos Andalucía, Teresa Rodríguez, y simuló besarla con el propósito de «pisotear» su dignidad con un acto «de contenido claramente sexista».
En la denuncia elevada a los juzgados de Sevilla, el Ministerio Público considera que, tal como describe la propia Teresa Rodríguez en un escrito elevado a la Fiscalía, los hechos podrían ser constitutivos de un delito contra la libertad sexual o de atentado a la autoridad.
En este sentido, la Fiscalía asevera que «por el designio que se supone perseguido por el denunciado y por las circunstancias concurrentes» en el caso, la conducta del empresario podría tener encaje, asimismo, en el tipo penal del artículo 173.1 del Código Penal, que impone pena de prisión al que infligiere a otra persona un trato degradante, menoscabando «gravemente» su integridad moral.
El Ministerio Público relata que los hechos habrían tenido lugar el 20 de diciembre de 2016, cuando Teresa Rodríguez acudió a un acto a la sede oficial de la Cámara de Comercio de Sevilla, al cual «había sido invitada por razón de las responsabilidades públicas que ejercía y que era presidido» por la presidenta de la Junta, Susana Díaz.
Sobre las 15,00 horas, y cuando la parlamentaria se disponía a abandonar el lugar tras concluir el acto, el empresario denunciado, «siendo consciente de la función representativa que cumplía» Teresa Rodríguez, y en presencia de varias personas más que habían acudido al acto -«en esa ocasión, casi todos eran hombres»-, «se abalanzó sobre ella empujándola hasta hacerla retroceder hacia un rincón».
«Humillación» y «vituperio»
Según recoge la Fiscalía, el empresario «tapó la boca de la mujer con su mano mientras aproximaba su boca a la de ella y besaba su propia mano, la que cubría la boca de ella, en un ademán como si, en realidad, la estuviera besando en los labios», todo ello «mientras pegaba su cuerpo contra el de la diputada, haciéndola retroceder hasta la pared», hasta que la parlamentaria «pudo desembarazarse y salir del lugar».
El Ministerio Público considera que «el propósito principal que anima al autor es el de pisotear la dignidad de la persona ofendida con un acto, de contenido claramente sexista, que pretende demostrar y alardear de una repudiable e indefendible idea que preconiza la primacía del hombre sobre la mujer, obligando a ésta, para su propia humillación y vituperio, a sentirse sometida sin remedio a ese poder y a ese imperio».
En este punto, el fiscal resalta que «no puede olvidarse que, en las circunstancias que concurrían, la entidad de la vejación se agranda muy considerablemente».
«Envilecimiento»
A su juicio, ello no se debe a que «la condición oficial de la víctima permita considerar que su dignidad, ahora herida, es de mayor importancia o valor que el que pudiera tener la de cualquier otra persona, la de cualquier otra mujer, sino porque en un acto público, contra una mujer que cumple en nuestra sociedad una función representativa conocida por todos y de inequívoca trascendencia, la muestra de desprecio, simplemente por esa condición de mujer, adquiere mayor entidad y repercusión».
Según el Ministerio Público, lo anterior se debe a «las propias posibilidades de difusión de la vejación y por la cualidad de la destinataria, que se elige como víctima, precisamente, para reforzar el sentido humillante de la mofa, de tal manera que para la persona que ha de sufrirlo, al ser consciente de todas esas circunstancias, la sensación de envilecimiento y de pérdida de dignidad, por fuerza, ha de ser enorme».
Por todo ello, y a fin de depurar las responsabilidades de orden penal a que hubiera lugar, la Fiscalía interesa la incoación de diligencias previas.
