Una jornada siguiendo el trabajo judicial de protección a las mujeres muestra las carencias del sistema. “No hay una solución que sirva para todas”, lamenta una fiscal
La primera frase siempre es esta: “Tranquila, voy a estar contigo”. El educador social Agustí Sapinya la dice mirando a los ojos de la mujer que suele llegar aterrorizada. “Te voy a acompañar durante toda tu presencia en el juzgado. Intentaré que no te cruces con tu agresor”. Es la primera y la última persona que las atiende. Su recorrido comienza en una sala multiusos que han cerrado para preservarlas del mundo. “Aquí se llora, se ríe, pasan las horas”, dice una abogada. Los juzgados españoles recibieron 390 denuncias al día por violencia machista en 2016. En el arranque de año más negro de la última década —con 16 asesinadas más una en investigación— EL PAÍS visita un juzgado en el que se estiran el tiempo y los medios para atender a mujeres rotas.
La tercera planta del Juzgado de Primera Instancia e Instrucción 4 de Sueca (Valencia), que dirige el magistrado José Luis Mendoza desde hace 15 años, es un hervidero en esta mañana de viernes. Desde 2005, las denuncias por violencia machista se tramitan en juzgados exclusivos (106) o los 355 mixtos, como el de Sueca, que también atienden otros casos penales y civiles. Se ha avanzado en una década, pero siguen faltando medios, tiempo y especialistas.
En Sueca, todo eso se suple con “voluntad de trabajo”, resume Mendoza. En su equipo hay un secretario judicial, ocho funcionarios (uno municipal), cinco agentes de Guardia Civil y 14 policías locales con los que se coordina por WhatsApp. Mendoza ha conseguido que haya un agente especializado en cada comisaría. En este juzgado mixto, la prioridad es la violencia machista. El 80% de los juicios rápidos son por estos casos. Es de los jueces que más pulseras contra el maltrato dicta de la Comunidad Valenciana y un convencido de la causa. Un hombre bueno, dicen sus colaboradores. Una de las funcionarias describe el trabajo diario como el de la sala de Urgencias de un hospital. A veces no pasa nada, pero muchos días viene un microbús accidentado.
Una de las víctimas de este año, asesinada en Gandía, había presentado denuncia en Sueca. El viernes 3 de marzo, acuden a declarar sus hijos a puerta cerrada. “Cuando ocurren cosas así, siempre te planteas si pudiste hacer algo más”, reflexiona el juez. “Pero no, en este caso, no era así”. Declina dar más datos de un caso en investigación. Este periódico accedió al resto de actuaciones de la mañana, con el compromiso de ocultar detalles que hicieran identificables los casos.
Entender “el contexto”
En el despacho del secretario judicial, un hombre escucha la grabación de una llamada telefónica que su expareja ha presentado como prueba para acreditar sus amenazas. Pide que se escuche la conversación completa y se entienda “el contexto”. “A veces es difícil de dilucidar, pero si un hombre escribe en un mensaje ‘te voy a matar’ o ‘me las vas a pagar’, no queda lugar a dudas”, explica el magistrado.
Antonio es uno de los guardias civiles especializados en violencia de género del juzgado. Su lista de 42 mujeres en vigilancia desgarra desde la estadística: la mayor, una anciana de 82. La más joven, una chica de 17. Cinco agresores en prisión, dos víctimas que conviven con sus maltratadores. Se coordina con el juez y el resto del equipo por un grupo de WhatsApp, una solución casera que se adelanta al plan del Consejo General del Poder Judicial (CGPJ) para que todos los que intervienen estén conectados y con datos en tiempo real.
Este agente entrega los informes que elabora la policía y que determinan el nivel de peligro al que están expuestas las mujeres. La gran mayoría señala riesgo “no apreciado” o “bajo”. Asociaciones de mujeres y la de Jueces para la Democracia han pedido mayor especialización en este asunto. El Observatorio de Violencia de Género del CGPJ quiere añadir la valoración “urgente” de psicólogos forenses que “examinarán también a los agresores para tener más elementos de valoración”, explica su presidenta, María Ángeles Carmona. “Un psicólogo especializado ve cosas que la policía no ve”.
El magistrado revisa la hoja de Excel que le ha dado Antonio con los riesgos: “Si pone que es no apreciado, las tienen que llamar cada 60 días. No sé qué sentido tiene tanta dilación. Es mejor que sea más continuado, sobre todo el primer mes”.
“No es que la valoración policial esté mal hecha, pero las mujeres minimizan mucho lo que les pasa, no se dan cuenta de su propio riesgo”, explica Rosa Guiralt junto al despacho del juez. Es fiscal coordinadora de Violencia sobre la Mujer de Valencia desde hace más de 10 años. “Lo más difícil es no disponer de psicólogos ni personal suficiente que aprenda a ver el riesgo real de las mujeres”. El estatuto de la víctima, de 2015, les reconoce el derecho a servicios de asistencia de las Administraciones no siempre disponibles, aunque no hay datos oficiales sobre estas carencias.
Sapinya, el hombre que recibe a las mujeres, es técnico de la oficina municipal de atención a la víctima de violencia de género de Sueca. Está cedido por el Ayuntamiento al juzgado. El año pasado atendió a 175 mujeres. Le preocupa “el desamparo que sufren tras salir del juzgado” ya que son “mujeres anuladas”. “Ninguna institución las atiende de acuerdo a sus necesidades”. “En el peor momento de sus vidas, sufren el mayor desamparo, en la base de esta sociedad machista. A veces, el mismo funcionario que les da el formulario [para solicitar las ayudas], les dice que han hecho polvo al hombre para venir a cobrar”. Hay dos testimonios que no puede borrar. Una mujer “con un tono de voz plano” le contó que, si salía de casa “sin permiso”, su marido le exploraba la vagina para ver si había mantenido relaciones sexuales. Otra le contó que su pareja la tiró desnuda a la calle. Otras veces son solo gestos pequeños, imperceptibles, que el técnico resume con un refrán: “El gato que se ha quemado, con agua escaldada tiene bastante”.
En el despacho del juez, de unos 20 metros cuadrados, hay seis personas. Una mujer de entre 30 y 40 años declara con gafas de sol y la mano de Agustì en su hombro. Denuncia como víctima por segunda vez. Viene a pedir que la protejan de su expareja y padre de su hijo menor, de apenas unos meses. Tiene una orden de alejamiento de 300 metros. Dice que está asustada por su hijo, al que él acaba de reconocer la paternidad. “El tema se ha ido de madre desde que sabe que tengo una nueva pareja”, le dice al juez. Asegura que él difunde vídeos difamatorios de ella y la insulta en las redes. Cuando ella sale, entra él en el despacho y lo niega todo. No se han cruzado. La fiscal se suma a la petición de la abogada y deciden que el hombre se mude seis meses a otra localidad donde tiene casa y se coloque la pulsera. Él recibe la decisión a regañadientes. Aún falta concretar si podrá ver a su hijo.
Al final de la jornada, Guiralt hace balance : “Hemos empezado por el palomar. Los cimientos son la educación y no están. Hay que empezar a enseñar en igualdad. Hay un fallo institucional, no tenemos una solución que sirva para todas. Pero algunas salen y, solo por ellas, ya merece la pena”. (Fuente: El País)
