Un informe del Consejo de Europa alerta del uso habitual de celdas compartidas
España tiene un nivel de población reclusa inferior a la media europea, pero la masificación de las cárceles figura entre las más altas del continente. Por cada 100 celdas disponibles, la Administración aloja a 119,6 presos, frente a una media europea de 91,4. Son datos divulgados este martes por el Consejo de Europa, la institución con sede en Estrasburgo que vela por el cumplimiento de los derechos humanos en todo el continente.
Se trata de la cuarta cifra más abultada de todo el mapa europeo (hay datos de 42 países), solo por detrás de Macedonia, Hungría y Bélgica y a la misma altura que Albania. El dato empeora sensiblemente si se excluye a Cataluña. El Consejo de Europa computa por separado las cifras catalanas porque esa comunidad tiene transferidas las competencias penitenciarias. Sin Cataluña, España alcanzaría el segundo peor registro (133 presos por cada 100 plazas) y el más alto si se cuentan solo los países de la UE, según cifras relativas a 2015.
Como en la mayoría de países europeos, la ley penitenciaria española obliga a alojar a un solo preso por celda. Solo “en caso de insuficiencia temporal de alojamiento o por indicación del médico” se puede vulnerar la norma. “Nadie duerme en el suelo, pero al alojar a más de una persona por celda, se fuerza la ley. Una insuficiencia que existe desde hace más de 10 años no puede calificarse de temporal”, evalúa Marcelo Aebi, director de la encuesta sobre prisiones presentada esta mañana en Bruselas.
Los datos que España ha comunicado a Estrasburgo arrojan un déficit de espacio en las cárceles. En septiembre de 2015, el país disponía de 53.512 celdas, mientras su población penitenciaria ascendía a 64.017 personas. Para acomodar a todos, se han habilitado dos espacios en muchas de estas celdas individuales, de manera que las plazas disponibles suben automáticamente a 77.783. La Administración aprovecha que esos recintos tienen unas dimensiones en la horquilla alta del rango europeo (9,9 metros cuadrados) para albergar a más de un recluso.
Los datos, pese a todo, encierran una trampa desfavorable a España. Porque el Consejo de Europa pregunta a los países por sus plazas disponibles, pero algunos no dan el número de celdas. Poco más de la mitad responden a la pregunta de cuántos recintos cerrados tienen en las prisiones y, de ellos, solo cuatro (incluida España) emplean el número de celdas para calcular la capacidad de sus prisiones. Muchos, por tanto, pueden alojar a más de una persona en la misma habitación, pero sin informar de ello. “Si recalculáramos la sobrepoblación carcelaria de todos los países según la cantidad de celdas, la posición de España mejoraría sensiblemente”, admite el director de la encuesta.
El Consejo de Europa no tiene herramientas para forzar a los países a dar los datos precisos y en la práctica hay algunos que no atienden la petición. Como ejemplo, Polonia, inmersa en una deriva autoritaria desde octubre de 2015, ha rehusado ofrecer cualquier tipo de cifra este año.
Más tiempo en prisión
España también figura por encima de la media en periodos de privación de libertad. La condena media es de 17,5 meses (aquí el dato empeora levemente al incorporar a la Administración catalana), frente a los 9,5 meses del conjunto de Europa. Países como Rumanía, Portugal, República Checa y Estonia superan el dato español. “Es el modelo contrario al de los países nórdicos: ellos envían más gente a prisión, pero por menos tiempo”, explica el experto del Consejo de Europa.
En el conjunto del continente, el análisis sobre población reclusa (un total de 1,4 millones en septiembre de 2015) mejora. La tasa de presos por cada 100.000 habitantes bajó un 7% respecto a 2014, aunque una de cada tres cárceles experimenta sobreocupación. Las administraciones gastan una media de 52 euros por recluso cada día, siete euros más que en el ejercicio anterior. Y el porcentaje de reclusos con penas muy largas o cadena perpetua representa el 11,4% del total, casi dos puntos menos que en 2014.
