El Juzgado de lo Penal Número 3 de València ha condenado a una multa de 1.800 euros a tres hombres que persiguieron, insultaron e intentaron impedir a una fotoperiodista que abandonara la localidad de Petrés (Valencia), a donde había acudido para tomar imágenes de los festejos taurinos del municipio. Además, condena también a uno de ellos por agredir a uno de los acompañantes de la fotógrafa tras intentar quitarle la cámara. Así consta en una sentencia fechada el pasado 14 de septiembre, facilitada por la Unió de Periodistes, por la que se condena por el delito de coacciones a estas tres personas, además de por lesiones leves a uno de ellos. Sin embargo, la jueza no estima que se haya producido un atentado contra el derecho a la información en los incidentes contra la periodista, como sostenía la acusación, puesto que la magistrada considera que «no ha resultado acreditada dicha condición» porque la informadora «no ha aportado contrato, ni acreditación documental alguna de los que se desprenda la relación profesional con el periódico para el que, según expuso, presta sus servicios». Tampoco ve acreditado que pusiera en conocimiento de la Comisión de los festejos que iba a realizar una cobertura freelance.
La titular del Juzgado de lo Penal Número 3 de València sí considera probado que en la tarde del 7 de agosto de 2014, la fotoperiodista se encontraba en Petrés tomando imágenes en los festejos taurinos de la localidad, acompañada por otras dos personas. Tras la cogida de un ciudadano por un toro, la informadora comenzó a sacar fotos cuando el herido estaba siendo trasladado a la ambulancia, algo que le fue recriminado por las personas presentes en las inmediaciones.
La fotoperiodista se dirigió hacia su vehículo, aparcado en las proximidades, mientras era perseguida por un grupo de personas que la insultaban. Cuando la profesional se introdujo en su vehículo junto a sus dos acompañantes, los aficionados del festejo taurino que rodeaban el turismo impidieron que abandonara el pueblo con «actos obstructivos» a su circulación, al tiempo que con ánimo exaltado «lanzaban imprecaciones» y abrieron la puerta del copiloto, tirando de la cámara de fotos que el acompañante llevaba en la mano. Finalmente, al salir del vehículo el acompañante para recuperar la cámara, fue «acometido» por uno de los individuos que rodeaban el vehículo y, como consecuencia, sufrió una contusión en el muslo. Por ello, la jueza condena por un delito de coacciones a tres personas a una multa de 1.800 euros y a uno de ellos, además, a otra multa de 150 por un delito leve de lesiones.
UNIÓ DE PERIODISTES: SE AVALA LA «DESPROTECCIÓN»
Tras conocer el contenido de esta sentencia y en relación con el rechazo de la jueza a estimar que se produjera un atentado al derecho a la información, La Unió de Periodistes Valencians ha defendido en un comunicado que «el respeto debido a las decisiones judiciales no impide opinar sobre la relación que parece establecer el texto de la sentencia entre la condición de trabajador en plantilla de un medio para poder ser titular del derecho fundamental a la información». Esta sentencia, manifiesta el colectivo de informadores, «deja en evidencia, todavía más, la precariedad con la que trabajan muchos de los y las periodistas (salarios bajos y flexibilización de las relaciones laborales, entre otros), a lo que ahora se suma la desprotección que avala esta sentencia».
«Consideramos que este pronunciamiento judicial vulnera el derecho a informar de periodistas y fotoperiodistas», añaden. La Unió de Periodistes Valencians señala también que «el derecho a la información de la ciudadanía y de los y las profesionales de la información, que recoge el artículo 20 de la Constitución Española, tiene que estar garantizado y respetado por los poderes públicos y nunca supeditado a relaciones laborales, sobre todo ante la precarización del periodismo»
