A pesar de declarar probados unos hechos gravísimos y de condenar por delitos de malversación, prevaricación, fraude en subvenciones y falsedad documental, entre otros, la sentencia impone unas penas que no están ni mínimamente en proporción con la gravedad de esos delitos.

València, 25 de abril de 2020.- Desde la Coordinadora Valenciana de ONGD calificamos como decepcionante e indignante la sentencia del Caso Blasco hecho pública ayer por la Audiencia Provincial de València, por la que se condena a penas ridículas al ex conseller Rafael Blasco, el empresario César Augusto Tauroni y a otros 19 de los 24 acusados por la trama de desvío de fondos destinados a proyectos de cooperación con más de una decena de países empobrecidos.
El tribunal ha sentenciado que la trama encabezada por Blasco y Tauroni fue real. Hay decenas páginas que detallan cómo trampeaban los procedimientos para adjudicar proyectos de cooperación a falsas ONGD, y que identifican al menos 27 empresas radicadas en España y EEUU, a los que los testaferros de Tauroni desviaban el dinero de las subvenciones públicas para cooperación. Y así un largo etcétera de hechos delictivos probados, para los que se imponen penas mínimas. En la Coordinadora Valenciana de ONGD, que hemos actuado en este proceso como acusación popular, estamos perplejos.
Anunciamos, por tanto, que recurriremos la sentencia ante el Tribunal Supremo para seguir luchando por que las penas impuestas a los acusados se correspondan con la gravedad de los delitos que ellos mismos y el tribunal han reconocido.
Atenuantes incomprensibles
En particular, resulta incomprensible que se apliquen a los condenados atenuantes como los de “dilación indebida” del procedimiento, cuando los retrasos han sido a causa de los recursos que han interpuesto a cada paso sus propias defensas, el de “reparación del daño causado”, cuando los condenados han devuelto una ínfima parte del dinero robado, así como el de “confesión tardía,” cuando la mayoría de los condenados se negaron a declarar en el acto del juicio. También es sorprendente que la sentencia no se ocupe de cuantificar con exactitud la cantidad del dinero que defraudaron los condenados, cuestionando el criterio de los peritos.
Consideramos absolutamente insuficientes y de dudosa validez los bienes que han ofrecido los condenados para resarcir a la ciudadanía valenciana por el dinero destinado a proyectos de cooperación internacional que desviaron en su propio beneficio. Son bienes que o no son de su propiedad o están embargados a cuenta de lo que tienen que pagar por otros juicios en los que han sido condenados antes.Esta sentencia no garantiza que los responsables de esa trama corrupta, una de las más inmorales que hemos sufrido en la Comunitat Valenciana, devuelvan el dinero robado o vayan a la cárcel como corresponde con la gravedad de los delitos que han cometido, que incluyen la malversación de fondos públicos, la prevaricación, el fraude de subvenciones, la falsedad documental y el blanqueo de capitales, entre otros. El mensaje que se está enviando a la sociedad es de impunidad y que cometer delitos de guante blanco sale muy barato.
Desde la Coordinadora queremos recordar que éste no era un caso de corrupción más. Ha sido una de las tramas más indignas y repugnantes a las que nos hemos enfrentado en los últimos años. Se aprovecharon del sufrimiento de miles de personas empobrecidas para enriquecerse personalmente. Las ONGD llevamos diez años luchando por que se haga justicia, para defender la dignidad de la cooperación y para lograr la devolución de los fondos defraudados. Vamos a seguir haciéndolo ante el Supremo.
Durante todo este proceso como acusación popular hemos recibido el respaldo de centenares de personas y entidades sociales a las que queremos agradecer su apoyo y decirles que vamos a seguir luchando por que se haga justicia. Después de todo lo que hemos sufrido durante muchos años con la corrupción, en la sociedad valenciana no podemos permitirnos que delitos tan graves sean sentenciados por la justicia dejando esta sensación de impunidad.
