Como siempre en estas fechas, el recuerdo del accidente llega a mi mente.
Y este año, acompañado del dolor y la frustración que supone ver el interés de la jueza en archivar el caso, sin investigar todas las posibles circunstancias que pudieran influir en el siniestro.
Es exasperante ver el empeño de Nieves Molina en excluir a FGV de cualquier responsabilidad en la muerte de 43 personas y las lesiones ocasionadas a otras 47.
Porque ese ha sido el camino señalado en la instrucción, establecer la NO RESPONSABILIDAD DE FGV.
Ya en 2006, el mandato que la jueza trasladó al perito Andrés Cortabitarte, simplemente fue para que estudiara qué había incidido en el exceso de velocidad.
NUNCA LE PIDIÓ QUE ANALIZARA TODAS LAS POSIBLES CAUSAS DEL ACCIDENTE.
Nieves Molina eligió una sola circunstancia, sin preocuparse del motivo de esa circunstancia, sin querer averiguar el porqué de ese exceso de velocidad.
Se centró en el conductor como responsable del exceso de velocidad, sin tener en cuenta que FGV disponía de sistemas para EVITAR ese exceso de velocidad.
Y este precepto ha sido inamovible a lo largo de todo el proceso: la única responsabilidad para el conductor, y no investigar ninguna otra circunstancia. Y si en el camino surge algún indicio de responsabilidad de la empresa, pues se obvia, y ya está.
Que FGV no contaba con un Plan de Prevención de Riesgos Laborales, a pesar que los artículos 14-15 y 16 de la Ley de Prevención obligan a la empresa (no al trabajador) a evitar los riesgos? No pasa nada…. lo que hay que hacer es instruir a los conductores en sus obligaciones y que sean ellos los que eviten los riesgos.
Ya está, se traslada la responsabilidad a los trabajadores, y la empresa queda libre de toda culpa.
Que los últimos informes revelan que FGV no contempla la velocidad como un Riesgo? No pasa nada….. , total, con que el conductor respete el límite de velocidad, ya no hay riego.
¿Veis? La culpa del conductor….
Y para terminar de alejar de FGV cualquier indicio de responsabilidad, la última “triquiñuela” ha sido etiquetar a la Velocidad como Seguridad Industrial.
Porque si consideramos que la Velocidad puede repercutir en la Seguridad y Salud de los trabajadores, tiene que considerarse Seguridad Laboral y corresponde a FGV evaluar ese Riesgo. (cosa que ya dijo el perito de la Inspección de Trabajo que no hizo)
Pero si la llamamos Seguridad Industrial, entonces la cosa cambia. En ese caso la responsabilidad es de los técnicos en seguridad ferroviaria. Que no sabemos quiénes son ni cómo se llaman, porque a la jueza no le ha interesado averiguarlo.
Una vez abierta la vía de la NO RESPONSABILIDAD DE FGV, se ha apresurado a cerrar la investigación, sin investigar nada más.
¿Pero acaso el objeto de la instrucción no es averiguar las causas del accidente? ¿O simplemente se trata de librar a FGV del posible delito de 43 homicidios y 47 lesiones? Porque eso es lo que parece….
11 años después, y eso es lo único que la instrucción judicial ha sacado en claro: que EVITAR EL EXCESO DE VELOCIDAD, NO ES RESPONSABILIDAD DE FGV.
¿Pero entonces, de quién????
Ni lo sabemos, ni a la jueza Nieves Molina le importa…..
¿Y de verdad no se puede hacer nada? ¿Nos tenemos que conformar con la (NO) investigación llevada a cabo por la jueza Nieves Molina? ¿Nos tenemos que conformar con no saber de quién es la responsabilidad del accidente?
¿Nos tenemos que conformar, viendo cómo se van pasando las culpas unos a otros, escurriendo el bulto para quitarse el muerto de encima? (y nunca mejor dicho…)
¿Y qué más da el nombre del campo de Seguridad al que pertenece el control de la Velocidad? Se llame como se llame, controlar el Riesgo que supone el exceso de velocidad, será competencia de alguien, no? ¿Por qué no sigue investigando?
Al final, entre unos y otros, 43 muertos, 47 heridos, y la casa sin barrer….
