Un tribunal federal de Argentina condenó a dos exdirectivos de la multinacional Ford a diez y quince años de prisión en una sentencia que por primera vez castiga a una cúpula empresarial por delitos de lesa humanidad perpetrados durante la última dictadura cívico militar (1976-1983).
El tribunal oral federal nº 1 de San Martín, en la provincia de Buenos Aires, condenó este martes a dos exdirectivos de Ford y a un militar retirado por secuestrar y torturar a 24 trabajadores de la automotriz estadounidense durante el terrorismo de Estado en Argentina.
La investigación duró quince años y la etapa de juicio oral se prolongó uno más. El tribunal argentino castigó con diez años de prisión a Pedro Müller, jefe de manufactura, y con quince años de cárcel a Héctor Sibila, jefe de seguridad de la planta que tenía Ford en General Pacheco, un polo industrial al noreste de la provincia de Buenos Aires.
Los dos exgerentes fueron condenados por ser partícipes necesarios de los tormentos y las privaciones ilegítimas de la libertad, agravadas por actos de violencia y amenazas, que sufrieron los empleados de la fábrica. Debido a su edad, ambos cumplirán prisión domiciliaria. Como se da por descontado su apelación, permanecerán en libertad hasta que la sentencia quede firme, aunque no podrán salir del país.

Los exjerarcas permitieron que se instalase un centro clandestino de detención dentro de la fábrica y señalaron a los obreros de la planta que debían ser secuestrados y torturados. Muchas de las víctimas eran delegados sindicales.
El tribunal argentino también sentenció a quince años de prisión al exmilitar Santiago Riveros, extitular de Institutos Militares del Ejército, considerado coautor de las torturas y los secuestros y condenado también por realizar allanamientos ilegales.
“Se trata de un hito en la sanción de la responsabilidad civil con el terrorismo de Estado”, destacó el Centro de Estudios Legales y Sociales (CELS), una entidad de derechos humanos que participa como querellante en muchas causas de lesa humanidad.

Un día después de que la junta militar diera el golpe de Estado el 24 de marzo de 1976, la cúpula directiva de la automotrz informó a sus empleados de que la comisión interna que los representaba ya no funcionaría más. “La empresa Ford Motor Argentina pasa a ser objetivo y prioridad militar”, dijo por entonces el gerente de relaciones industriales de la automotriz, Guillermo Galarraga, también procesado en esta causa pero fallecido durante el proceso.
Ford fue una de las empresas que colaboró activamente en el plan sistemático de aniquilación que llevó a cabo la junta militar de Argentina. La multinacional puso a disposición sus recursos y su personal para contribuir al aparato represivo que persiguió y asesinó a disidentes durante el régimen dictatorial.
Por ello entregó a las fuerzas militares un listado de los empleados que debían ser detenidos; facilitó legajos personales, fotografías y hasta camionetas para agilizar los traslados. Muchas de los secuestros se realizaron a plena luz del día dentro de la fábrica, en horario de trabajo, frente a otros compañeros de la planta.
La participación de Ford en los delitos de lesa humanidad tuvo lugar en uno de los principales cordones industriales del país, donde se gestó uno de los principales epicentros de protesta contra la dictadura.
El dictador Jorge Videla, que encabezó la junta militar entre 1976 y 1979, reconoció la labor de Ford durante aquellos años. Su ministro del interior, el general Albano Harguindeguy, pidió a la filial argentina en 1977 que fabricara de 90 vehículos Ford Falcon no identificables para que pasaran desapercibidos. Muchos saldrían de la fábrica de General Pacheco.
Estos vehículos, que fueron repartidos a las policías provinciales de todo el país, se convirtieron en un emblema del terror de aquellos años. Por lo general eran de color verde, y circulaban sin matrícula, de madrugada. La conciencia colectiva los identifica como uno de los símbolos más siniestros de la dictadura. Las víctimas, maniatadas y con los ojos vendados, eran encerradas en el maletero. Los Ford Falcon constituyen el lugar en donde se vio por última vez con vida a tantos que luego engrosarían las listas de desaparecidos.
El CELS estima que el 7% de los civiles acusados de crímenes de lesa humanidad son empresarios. El año que viene se celebrará otro juicio en el que algunos militares serán acusados de delitos cometidos contra al menos 20 trabajadores de Mercedes Benz, de los cuales 15 siguen desaparecidos, pero la evidencia puede mostrar la responsabilidad de los directivos de la empresa.
El primer empresario que fue condenado por primera vez por delitos de lesa humanidad durante la dictadura fue Marcos Levin, dueño de la empresa de autobuses Veloz del Norte, sentenciado en marzo de 2016 a doce años de cárcel por secuestros y torturas. El juicio contra Levin fue anulado al año siguiente por la Cámara de Casación Penal, el máximo tribunal del fuero penal, pero en septiembre pasado la Corte Suprema ordenó reabrir la causa.
Otras empresas que están siendo investigadas por crímenes de lesa humanidad son la azucarera Ledesma, la industria siderúrgica Acindar y la agroalimentaria Molinos de la Plata.
