El capitán de la Guardia Civil en Vélez-Málaga, Salvador Jiménez, que coordinó a los agentes que participaron en el rescate de Julen, el niño de dos años que fue rescatado sin vida a los 13 días de caer en un pozo en Totalán (Málaga), ha asegurado que los agentes de la Benemérita actuaron con «la mejor profesionalidad» en el operativo.
Jiménez se ha manifestado así en declaraciones a los medios en el acto de entrega de las Medallas de Andalucía en Sevilla, donde ha hecho hincapié en que todas las cuestiones en relación al rescate «se hacían con la mejor intención para, en el caso de que ese chico estuviera vivo, mantenerlo con vida, lógicamente».

Así ha respondido el capitán a preguntas de los periodistas sobre la presentación este pasado miércoles por parte de la defensa del dueño de la finca donde está el pozo en el que cayó Julen en el Juzgado de Instrucción número 9 de Málaga, que lleva el caso, de un informe cuyas conclusiones «permiten presumir» que la muerte del pequeño «se pudo producir durante las labores de rescate» y en el que se apunta que podría ser el uso de una piqueta en las primeras horas de dichas tareas lo que explique las heridas que presentaba el menor.
Jiménez, que ha negado saber de ese informe, ha expuesto que «desde el primer momento» en que él se incorporó al operativo, comprobó como «no había descanso» y que todos las personas implicadas actuaron con «la mejor ilusión para que Julen estuviera hoy con nosotros aquí vivo».
Así, para ilustrar la «profesionalidad» y la entrega de los rescatadores, ha citado el caso de un ingeniero que, tras sufrir su padre un infarto, se fue y regresó, ya que «su padre lo mandó al tajo porque decía que era más importante encontrar al niño que él mismo».
«Nosotros no teníamos ni ganas de dormir ni de llegar a casa, lo que queríamos era llegar a casa cuando hubiéramos terminado nuestro trabajo, lo que pasa es que nada de lo que se probaba tenía un resultado favorable, por lo que la gente ha tenido un desgaste que, lejos de manifestarlo allí, yo creo que lo estarán sintiendo los días posteriores», ha manifestado respecto al estado anímico del equipo.
El informe técnico encargado por la defensa del dueño de la referida finca, David Serrano, -que está investigado en esta causa- a un arquitecto que colabora en este caso con el despacho de abogados, señala como una de las conclusiones que «las actuaciones con la piqueta, diez impactos en total, entre las 17.30 y las 21.00 horas del día del incidente es lo único que físicamente pudo producir las heridas en la cabeza y cráneo del menor».
Recuerda que los forenses dictaminan -en un informe de autopsia preliminar, porque aún no está el definitivo- que el fallecimiento se produjo «como consecuencia de un traumatismo cráneo-encefálico severo que afectó a la zona temporal y fronto-temporal» el mismo día de la caída, apuntando el informe que «esa zona lateral de su cabeza difícilmente pudo recibir un impacto de esa magnitud durante la caída».
El documento, realizado con las grabaciones y otras informaciones que forman parte del sumario y que se centra entre las 15,30 y las 00,00 horas del domingo -día de la caída-, señala que «el hecho de que tras extraer la piqueta por última vez se recogiesen de su extremo ocho pelos del menor, tres de ellos con raíz telógena, nos lleva a preguntarnos, ¿Qué otra tesis alternativa a la del impacto directo contra la cabeza del menor puede llegar a explicar la presencia de esos restos biológicos en la punta de la piqueta?».
El letrado defensor del dueño de la finca, Antonio Flores, señaló en declaraciones que se trata de un informe «técnico que no viene a establecer culpas, sino esclarecer la verdad también a efectos de nuestro cliente», apuntado que «entendemos que no es lo mismo que el niño hubiera fallecido al impacto con el suelo o unas horas después, porque podría cambiar la calificación jurídica».
Indicó que «si se encuentran ocho pelos en la piqueta y tres de ellos son arrancados de raíz, podemos por lo menos suponer que podría ser causa», apuntando que al pequeño lo escuchan llorar durante unos segundos tras la caída.
El informe considera constatado que el menor «se encontraba, en los primeros instantes tras su caída, bajo una capa de tierra y material de entre diez centímetros y 15 centímetros de espesor» y apunta que los últimos cuatro impactos con la piqueta «penetraron al menos 35 centímetros» del tapón que había sobre Julen.
A partir de este informe de parte, la defensa pide que se amplíen las diligencias para «el mejor esclarecimiento de los hechos», ya que, según señala en otro escrito, este estudio técnico «permite presumir que la muerte se pudo producir durante las labores de rescate y no durante la caída».
Por esto, solicitan que se llame a declarar a responsables técnicos y agentes del Consorcio Provincial de Bomberos que participaron en el rescate y a agentes de la Unidad de Montaña del instituto armado; pidiendo, además, que la Guardia Civil realice estudio de la composición de las muestras de tierra recogida en la parte superior del niño.
